Public WiFi Access Terms and Conditions of Use

This Agreement sets out the terms and conditions on which wireless internet access ("the Service") is provided free of charge to you, a guest, vendor, trustees, invitees or employee of the Denver Art Museum (the "Museum") in selected areas of the Museum with portable computers or other devices.

Your access to the Service is completely at the discretion of the Museum. Access to the Service may be blocked, suspended, or terminated at any time for any reason including, but not limited to, violation of this Agreement, actions that may lead to liability for the Museum, disruption of access to other users or networks, and violation of applicable laws or regulations. The Museum reserves the right to monitor and collect information while you are connected to the Service and that the collected information can be used at discretion of the Museum, including sharing the information with any law enforcement agencies, the Museum partners and/or the Museum vendors.

We reserve the right at all times to withdraw the Service, change the specifications or manner of use of the Service, to change access codes, usernames, passwords or other security information necessary to access the service.

You are expected to use the Service in a legal and responsible manner. While using the Service, you agree not violate federal, State, or local laws and regulations, including but not limited to those relating to: (i) the transmission or receiving of any pornography or harmful material. Accessing or displaying obscene language or sexually explicit graphics or materials is prohibited, (ii) fraud. You are prohibited from misrepresenting yourself as another user, attempting to modify or gain access to files, passwords, or data belonging to others, seeking unauthorized access to any computer system, or damaging or altering software components of any network or database, and (iii) downloading copyrighted material. U.S. copyright law prohibits the unauthorized reproduction or distribution of copyrighted materials, except as permitted by the principles of "fair use." You may not copy or distribute electronic materials without the explicit permission of the copyright holder.

Use of the Service to access or transmit any inappropriate, offensive or disturbing material may result in a permanent ban on future access to the Service.

Security Considerations

Wireless access is by nature an insecure medium. As with most guest wireless networks, any information being sent or received over the Service could potentially be intercepted by another wireless user. You should not transmit credit card information, passwords and any other sensitive personal information while using the Service. The Museum assumes no liability for any such transmission.

You agree that there can be no expectation of privacy when using the Service. You assume all associated risks and agree to hold harmless the Museum and its employees for any personal information (e.g. credit card) that is compromised, or for any damage caused to your hardware or software due to electric surges, security issues or consequences caused by viruses or hacking. You agree to have up-to-date virus protection on their personal laptop computers or wireless devices, and you agree to stay up-to-date with applicable OS security patches.

Disclaimer

The Museum is providing wireless connectivity as a guest service and offers no guarantees that any use of the wireless connection is in any way secure, or that any privacy can be protected when using the Service. Use of the Service is entirely at your risk, and the Museum is not responsible for any loss of any information that may arise from the use of the Service, or for any loss, injury, or damages resulting from the use of the wireless connection. You agree that the Museum shall not be liable for any deficiency in performance caused in whole or in part by the act or omission of the Service, an underlying carrier or service provider, equipment or facility failure, network problems, interference, lack of coverage or network capacity, acts of God, strikes, fire, war, terrorism, riot, emergency, government actions or any other cause beyond our control.

Under no circumstances will the Museum, its suppliers or licensors, or Museum, its suppliers or licensors respective officers, directors, employees, agents, and affiliates be liable for consequential, indirect, special, punitive or incidental damages, whether foreseeable or unforeseeable, based on claims of you or your appointees (including, but not limited to, unauthorized access, damage, or theft of your system or data, claims for loss of goodwill, claims for loss of data, use of or reliance on the service, stoppage of other work or impairment of other assets, or damage caused to equipment or programs from any virus or other harmful application), arising out of breach or failure of express or implied warranty, breach of contract, misrepresentation, negligence, strict liability in tort or otherwise.

Agreement

The Museum may revise this Agreement at any time. You must agree this Agreement each time you use the Service and it is your responsibility to review it for any changes each time.
